In February 2020, the Trump administration implemented a new rule for individuals applying for green cards through family-based petitions. The new rule imposed much more difficult financial requirements on family petitioners, and mandated that applicants for permanent residence must provide extensive documentation and information regarding household finances, health insurance, credit reports, education, and English language skills. We are pleased to report that the Biden administration has abandoned this ill-conceived wealth test. USCIS will not be changing the public charge assessment, but rather will continue to use the provision that has been in place since 1999.
